• You will comply with all applicable laws and regulations.
3. Description of Services
SWOT-AI.com provides AI-powered business intelligence tools, including but not limited to:
• SWOT analysis generation
• Strategic recommendations
• Forecasting and predictive analytics
• Data visualizations
• AI-generated business insights
• Exportable reports and documents
The Services use artificial intelligence and automated systems to generate outputs based on user-provided information.
4. No Professional Advice
THE SERVICES ARE PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY.
SWOT-AI.com does not provide legal advice, financial advice, accounting advice, investment advice, tax advice, business consulting services, or professional certifications or guarantees.
Any outputs, recommendations, forecasts, analyses, projections, narratives, or insights generated by the Services are automated AI-generated content and should not be relied upon as the sole basis for business, financial, legal, operational, employment, or investment decisions.
You are solely responsible for independently reviewing, verifying, and validating all outputs before relying on them.
5. No Guarantees or Warranties
The Services are provided on an "AS IS" and "AS AVAILABLE" basis.
To the fullest extent permitted by law, SWOT-AI.com disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, reliability, availability, non-infringement, completeness of outputs, fitness of recommendations, and future business performance.
AI systems may produce inaccurate, incomplete, outdated, biased, or misleading information.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWOT-AI.COM, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES — including lost profits, lost revenue, lost business opportunities, data loss, business interruption, reputational harm, financial losses, investment losses, operational losses, regulatory penalties, or third-party claims — arising from use of the Services, reliance on AI-generated outputs, forecast inaccuracies, service interruptions, or decisions made based on outputs.
REGARDLESS OF THE LEGAL THEORY ASSERTED, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF:
(a) THE AMOUNT YOU PAID TO SWOT-AI.COM DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM; OR
(b) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain liability limitations, so portions of this section may not apply to you.
7. User Responsibility
You acknowledge and agree that:
• You are solely responsible for your business decisions.
• AI-generated outputs may contain inaccuracies.
• You must independently validate all recommendations.
• You assume all risks associated with use of the Services.
• You will seek qualified professional advice where appropriate.
You agree not to use the Services as the sole basis for investment decisions, legal compliance decisions, tax filings, employment actions, financial reporting, regulatory submissions, or emergency decisions.
8. User Content and Uploads
You may upload documents, files, text, images, spreadsheets, or other content ("User Content") to the Services. You retain ownership of your User Content.
By uploading User Content, you grant SWOT-AI.com a worldwide, non-exclusive, royalty-free license to store, process, analyze, transmit, display, and use such content solely for the purpose of operating, improving, and providing the Services.
You represent and warrant that you own or have rights to the User Content, the User Content does not violate any law, infringe intellectual property rights, or contain malicious software.
We reserve the right to remove any User Content at our discretion.
9. Data Security and Privacy
While we implement reasonable safeguards, no internet-based service is completely secure. You acknowledge that data transmission over the internet carries inherent risks, we cannot guarantee absolute security, and you upload information at your own risk.
Your use of the Services is also governed by our Privacy Policy.
10. Prohibited Uses
You agree not to use the Services unlawfully, reverse engineer the platform, attempt unauthorized access, upload malware or harmful code, interfere with platform operations, resell or sublicense the Services without permission, use automated scraping tools, violate intellectual property rights, or submit false or misleading information.
We may suspend or terminate accounts violating these Terms.
11. Billing and Payments
The Services are billed on a pay-per-run basis. There is no subscription and no recurring fee. You are charged a flat fee for each analysis, forecast, advisor session, or simulation you run, plus any applicable usage-based charges disclosed at the time of the run. By saving a payment method, you authorize us to charge it through our third-party payment processor for the runs you initiate. Fees are non-refundable except where required by law or where a run fails through no fault of your own. We reserve the right to change pricing at any time; price changes do not affect runs already completed.
12. Account Termination
We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Services at any time. Sections intended to survive termination shall remain in effect.
13. Intellectual Property
All platform content, software, branding, designs, text, graphics, AI systems, workflows, and related materials are owned by SWOT-AI.com or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without written permission.
14. Indemnification
You agree to defend, indemnify, and hold harmless SWOT-AI.com and its owners, employees, contractors, affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, or expenses, including attorneys' fees, arising out of or related to your use of the Services, your User Content, your violation of these Terms, your violation of applicable law, or your reliance on AI-generated outputs.
15. Arbitration and Class Action Waiver
Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively through binding arbitration in the State of Illinois, except where prohibited by law.
You waive any right to participate in class actions, class arbitrations, representative actions, or jury trials. Disputes must be brought individually.
16. Governing Law
These Terms shall be governed by and construed under the laws of the State of Illinois, without regard to conflict of law principles.
17. Modifications to Terms
We reserve the right to modify these Terms at any time. Updated Terms become effective upon posting. Continued use of the Services after changes constitutes acceptance of the revised Terms.
18. Severability
If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms constitute the entire agreement between you and SWOT-AI.com regarding the Services and supersede all prior agreements.
20. Acknowledgment
BY CREATING AN ACCOUNT OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS; YOU UNDERSTAND THESE TERMS; YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS; YOU ACCEPT ALL RISKS ASSOCIATED WITH AI-GENERATED OUTPUTS; AND YOU UNDERSTAND THAT SWOT-AI.COM IS NOT LIABLE FOR BUSINESS DECISIONS MADE USING THE SERVICES.
